DMCA Policy

Last updated

NamesCombiner respects the intellectual property rights of others and expects users of namescombiner.net (the “Site”) to do the same. We respond to notices of alleged copyright infringement that comply with the US Digital Millennium Copyright Act (“DMCA”), 17 U.S.C. § 512, and to equivalent notices under other applicable laws, including UK copyright law.

Designated copyright agent

Send copyright notices to our designated agent:

DMCA Agent, NamesCombiner
Email: support@namescombiner.net (subject line: “DMCA Notice”)
Website: namescombiner.net

Filing a takedown notice

If you believe content on the Site infringes your copyright, send a written notice that includes all of the following (17 U.S.C. § 512(c)(3)):

  1. A physical or electronic signature of the copyright owner or a person authorised to act on their behalf;
  2. Identification of the copyrighted work you claim has been infringed (or a representative list if multiple works are covered);
  3. Identification of the material you claim is infringing, with enough detail for us to locate it — ideally the exact URL(s) on namescombiner.net;
  4. Your contact information: name, postal address, telephone number and email address;
  5. A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law;
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or authorised to act on the owner’s behalf.

Incomplete notices may not be actioned. Please note that under 17 U.S.C. § 512(f), anyone who knowingly makes material misrepresentations in a notice or counter-notice may be liable for damages.

What happens next

When we receive a valid notice, we will act promptly to remove or disable access to the material, make reasonable efforts to notify the person who provided it (where applicable), and keep a record of the notice.

Filing a counter-notice

If you believe material was removed by mistake or misidentification, you may send a counter-notice to the agent above that includes (17 U.S.C. § 512(g)(3)):

  1. Your physical or electronic signature;
  2. Identification of the material that was removed and where it appeared before removal;
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification;
  4. Your name, address and telephone number, and a statement that you consent to the jurisdiction of the US Federal District Court for your address (or, if outside the US, any judicial district in which NamesCombiner may be found), and that you will accept service of process from the person who submitted the original notice or their agent.

If we receive a valid counter-notice, we may restore the material after 10 to 14 business days unless the original complainant notifies us that they have filed a court action.

Repeat infringers

Where applicable, we will restrict access for users who repeatedly infringe the rights of others.
